Rep. Harwell To Focus On State Legislature

01.17.06

State Representative Beth Harwell today announced she will continue to serve in the Tennessee General Assembly after considering a race for governor. The following is a statement from Harwell regarding this decision:

“I have been encouraged to consider a bid for governor. Over the holidays my family and I decided that, for now, my work is in the State House, and I intend to do everything I can to ensure a better Tennessee for our children and our grandchildren.

“I can think of no higher honor than to serve the people of Tennessee as their governor. But right now my focus is helping to restore trust on Capitol Hill and in state government.”

Press Release, Carl Whitaker.
On Thursday, June 28, 1787, the Constitutional Convention in Philadelphia was in turmoil, split among itself and embroiled in a bitter battle over how this new nation called America would be governed. Tensions were high on both sides. Several delegates even walked out. Then, Benjamin Franklin rose to speak in this moment of crisis and said:
“The longer I live, the more convincing proofs I see of this truth: ‘that God governs in the affairs of men.’ And if a sparrow cannot fall to the ground without His notice, is it probable that an empire can rise without His aid?”
Today, I pose that same question to the people of Tennessee: How can we possibly hope to overcome Tennessee’s many challenges without petitioning God for His help in the road that lies before us? If ever we needed His aid and grace, it is now.
My fellow Tennesseans, I daily get on my knees to petition Our Lord for His help with the mess that that our State is in, this is why I have decided to run for the office of Governor. I want to give the state back to the People.

Once again Benjamin Franklin when asked by a woman what type of Government have we been given, Franklin said, ” A REPUBLIC, IF YOU CAN KEEP IT”. Friends, you continue to hear Politicians speak of Democracy or of a Dmocratic Government…..This is NOT what our founding fathers gave us, no where in the US Constitution do you see these words….but you do see Republic.
A Republic stands for individual Sovereign rights where as a Democratic Government stands for Mob Rule.

I promise to follow two things to help guide me as Your Governor, one is the Holy Bible, the other is the US & Tennessee Constitution.
There are many bills that go up daily that are in direct violatio of both of these writings, I as Governor will refuse to sign any bill that is in violation of them. The general misconception is that any
statute passed by legislators bearing the appearance of law constitutes the law of the
land. The U. S. Constitution is the supreme law of the land, and any statute, to be valid, must be in agreement. It is impossible for a law which violates the Constitution to be valid. This is succinctly stated as follows:

‘All laws which are repugnant to the Constitution are null and void.’ Marbury vs.
Madison. 5 US (2 Cranch) 137. 174, 176, (1803)

‘Where rights secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them.”
Miranda vs. Arizona, 384 US 436 p. 491.

“An unconstitutional act is not law; it confers no rights; it imposes no duties; affords no protection; it creates no office; it is in legal contemplation, as inoperative as though it had never been passed.”
Norton vs. Shelby County
118 US 425 p. 442

The general rule is that an unconstitutional statute, though having the form and name of law, is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of its enactment, and not merely from the date of the decision so branding it.

“No one is bound to obey an Unconstitutional law and no courts are bound to enforce it.

late 2d. Sec 256
There fore my fellow Tennesseans, you see that as I run to become the next Governor of this great state, I run on the foundation of our founding fathers……elected officials are to be PUBLIC SERVANTS…not dictators, it is not our job to rule over you, it is not our job to intrude into your home life, it is not our job to intrude on you way of worship. Government is not a babysitter, it is not your parents and sure is not sitting on the throne of GOD.
Our State legislators are suppose to listen to the people of their district, bring “their voice” to session and fight for the Voice of their constitutints, as long as it does not violate the constitution, thier job is not to dictate their own feelings and beliefs. We have too many laws as it is, let us enforce the Constitutional Laws that are on the books before making new ones.
I as your Governor, will do all in my power to fight for you to regain your freedoms, your God given Rights; I will work with any and all Legislators who wish to do the same.
Help me to become the next Governor of Tennessee and I will put us on the right road to a better future.
