Sept. 24, 2008: The Department of Justice presents a case to a grand jury and they decline to hand down an indictment. Terry Frank provides more background on Kernell’s attorney, Wade Davies. Wired has a story with more details and the full text of Davies’ statement to the press.
Sept. 23, 2008: Was he tipped off before the raid? David met with his lawyer late Monday, Wade Davies. The Commercial Appeal and the Knoxville News-Sentinel seem to have combined reporters to create a single story that is being modified as new data become available. CA story here and KNS story here. WMC has a video report with at least one “witness” claiming to have seen two people running away from the area of the apartment about five minutes before the FBI showed up Saturday night. Was this Kernell; if so, who tipped him off?
